01 Acceptance of Terms

By downloading, installing, or using the CHIKITSHA app or website ("Platform"), you ("User") agree to be legally bound by these Terms & Conditions and our Privacy Policy, which is incorporated herein by reference.

These Terms constitute a binding agreement between you and CHIKITSHA Online ("Company", "we", "us"). We reserve the right to update these Terms at any time with 30 days' notice.

02 Our Services

CHIKITSHA is a digital healthcare platform that provides secure video consultations with verified doctors. Our services include:

• Video consultations with registered and verified medical practitioners
• Specialist consultations across Gynaecology, General Medicine, ENT, Dermatology, Paediatrics, Diabetology, Nephrology, Diet & Nutrition, IVF & Fertility, and Homeopathy
• Digital prescriptions issued by consulting doctors within the app
• Secure consultation history and health records management
• Follow-up consultations with the same doctor

CHIKITSHA provides video consultation services only. We do not provide physical appointments, home visits, lab tests, diagnostic services, or any in-person medical services.

03 Eligibility

To use our Platform you must:

• Be at least 18 years of age, or have parental or guardian consent if a minor
• Be accessing the Platform from a legally permitted jurisdiction
• Provide accurate, current, and complete information during registration
• Not be barred from receiving services under applicable law

04 User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:

• Notify us immediately of any unauthorised access at support@chikitsha.com
• Not share your account with others or create multiple accounts
• Provide truthful and accurate health information during consultations
• Not use another person's account or impersonate any individual

05 Medical Disclaimer

We do not guarantee the accuracy of any medical advice, diagnosis, or treatment provided by doctors on our platform. Medical decisions remain the professional responsibility of the consulting physician and the informed choice of the patient.

06 Doctor Terms

Doctors registered on our platform agree to:

• Maintain valid medical licences and registrations at all times
• Adhere to the Indian Medical Council Act and applicable healthcare regulations
• Maintain patient confidentiality and comply with our Privacy Policy
• Join scheduled video sessions on time and conduct consultations professionally
• Not engage in any unethical medical or commercial practices

07 Payments & Billing

All payments on CHIKITSHA are processed through RBI-compliant payment gateways. By making a payment you confirm that:

• You are authorised to use the payment method provided
• All charges are in Indian Rupees (INR) and inclusive of applicable GST
• Refunds are subject to our Refund & Cancellation Policy
• We are not responsible for charges levied by your bank or card issuer

08 Intellectual Property

All content on the CHIKITSHA platform — including logos, brand name, design, software, text, graphics, and data — is the exclusive property of CHIKITSHA Online and is protected under Indian and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

09 Limitation of Liability

To the maximum extent permitted by law, CHIKITSHA Online shall not be liable for:

• Any indirect, incidental, or consequential damages arising from use of the Platform
• Medical outcomes resulting from video consultations or treatments advised
• Service interruptions due to technical failures beyond our control
• Loss of data due to factors outside our reasonable control

Our total liability in any dispute shall not exceed the amount paid by you for the specific consultation in question.

10 Termination

We reserve the right to suspend or terminate your account at any time without prior notice if you violate these Terms or engage in fraudulent activity. You may delete your account at any time from the app's Profile settings. Termination does not relieve you of obligations for pending payments.

11 Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Kolkata, West Bengal.
